A court order made public on Tuesday reveals that Marion Superior Court Judge Theodore Sosin is ordering both Jennifer Nettles and Kristian Bush to testify about the events leading up to last August’s stage collapse at the Indiana State Fair. Previously it was believed that only Nettles would have to give a deposition.

The Indy Channel (Indianapolis’s ABC affiliate) reports Sugarland‘s attorneys were ordered to choose a date between April 2 and 13 for both halves of the duo to show up. A spokesman for the band says they have complied with that order, but didn’t provide any further details. The In Your Hands Tour begins on April 5 in Toledo, Ohio, with five more dates in Ohio, Ontario and Kentucky before April 15.

The focus of the testimony will be on whether or not Sugarland avoided delaying the start of their set on August 13, 2011. Just moments before they were due to walk on stage, devastating winds knocked the stage roof and light rigging over onto the crowd. Seven were killed and dozens were injured in the tragedy. A State Fair official testified that the duo did resist delaying the concert, as it would have set their travel plans behind. Sugarland has maintained that the accident was not their fault.
